Management of tax disputes

Conducting tax disputes means that we will represent you in the process of tax disputes in the system of the Ministry of Finance and in all instances in the court in order to protect the interests of your company, in connection with the amounts charged by the Revenue Service with a tax request.

As you know, there are many ambiguous and vague entries in the tax legislation of Georgia, which allows them to be interpreted in different ways, and this is in many cases the reason why the tax authority, during the tax audit, charges taxes and sanctions on a basis inconsistent with the applicable legislation. Therefore, despite a number of reforms in the revenue service, the tax disputes service does not lose its relevance and maintains a growing trend. At this time, it is important for the dispute process to proceed in the right direction, to accurately identify the amounts that were wrongly charged by the Revenue Service. It is important to formulate the correct argumentation and strategy regarding the charged amount, which will bring success to our clients in the direction of making the decision they want in the dispute process. We will ensure that this process is conducted successfully, just as many other dispute processes have been conducted and concluded with great success by our company's highly skilled team. It is worth noting that as a result of the dispute, without the consent of the appellant, it is not allowed to burden the tax obligations of the appellant company, therefore, if you think that the amounts of taxes and penalties charged by the tax authority are not correct, you should use this opportunity and appeal the relevant tax request of the Revenue Service in order to reduce the amount of taxes and penalties charged by the tax authority. The part of the sanctions which was wrongly charged by the Revenue Service.

The tax dispute process includes two stages:
 At the first stage, the tax charged by the audit department is appealed to the dispute resolution service of the Revenue Service. In the event that the Disputes Department of the Revenue Service has made an unfavorable decision for the company, the dispute process moves to the second stage and this time the complaint is submitted to the Dispute Review Board under the Ministry of Finance of Georgia. If even at the second stage of the dispute, the desired decision for the company could not be reached, in this case the third stage of the dispute continues in court. Our support in the tax dispute process includes:

  • participation in the investigation and submission of evidence necessary for the dispute;
  • preparation of necessary procedural documentation based on preliminary analysis;
  • drawing up a complaint and appealing it;
  • participate in the dispute during the review of the complaint;
  • providing written and/or oral explanations and conclusions;
