The obligation to submit information related to leased spaces for fairs on a monthly basis was established.

According to the changes made in the 996th order of the Minister of Finance, the markets were given a new obligation to submit information about leased premises on a monthly basis.

Market (market area) is a plot of land owned/owned by a person and/or a group of persons, on which there are stationary trading facilities and non-stationary trading places or only non-stationary trading places (not less than 10 non-stationary trading places) intended for the sale of goods.

A non-stationary trading place (temporary building-structure) is a collapsible and/or mobile building system composed of anchor elements, which is connected to the ground by its own weight (for example, a counter) and/or by dry non-monolithic fastenings and which does not have underground storage facilities, as well as a vehicle used for this purpose means.

According to the change in the legislation, the market is obliged at the latest Submit the following information by the 15th of the month following the month of leasing the stationary trade facility and/or non-stationary trade space:

a) name, identification number, legal form and legal address of the lessee;

b) trade name of the fair;

c) land cadastral code(s) and corresponding address(es);

d) number of stationary and non-stationary objects;

e) information about the lessee and sublessee, including: name, identification number, legal form, in the case of a natural person - information about citizenship;

f) type of activity of the lessee/sublessee;

g) area (sq.m) and type of leased/subleased facility;

h) Lease/sublease agreement number, date, amount in national currency, date of start, end, change and termination of the agreement;

i) other information determined by the order of the head of the revenue service.

In case of leasing of new premises or changes in the contract (extension or termination of the contract), the market is obliged to submit the above-mentioned information on a monthly basis within the same period (no later than the 15th of the following month).

In addition to the obligations established for the fair, a new obligation was also imposed on the tenants (sub-tenants) working in the area of ​​the fair, in particular in the case of subleasing the stationary trading facility/non-stationary trading place leased by them at the fair, The mentioned persons are obliged to notify the above-mentioned person about this within 5 working days after subleasing.

For the violation of the obligation established by the legislation, the person will be held responsible in accordance with the tax legislation of Georgia.

The legislative change will come into force from April 2024, 1 (the information on the lease relationship that originated before April 2024, 1 must be submitted no later than May 2024, 31) and it is aimed at the administration of taxes payable by persons carrying out activities at the market.
